In civil law, every element of civil legal contracts has an important place in the life of society and citizens. Also, every person who owns a car is faced almost every day with regard to the placement of their car in special parking areas.
In this case, regulation of the relationship between the parking administration and the car owner, including the establishment of norms regarding the rights and obligations of the car owner and the parking lots, as well as the regulation of agreements and disputes arising between the parties through these norms need to apply. In this case, the agreement between the parties and disputes are regulated by the storage contract. The owner of the vehicle is the depositor, and the parking is the warehouseman.
In this article, the essence of the storage contract of a motor vehicle in the parking, foreign experience in regulating this relationship, achievements and comings of foreign countries, and the future of this industry in the Republic of Uzbekistan are discussed in detail.
Fuqarolik huquqida fuqarolik huquqiy shartnomalarning har bir elementi jamiyat hamda fuqarolar hayotida muhim o’rin tutadi. Xuddi shuningdek, avtomoshinaga ega bo’lgan har bir shaxs, o’z avtomoshinasini maxsus saqlash joylari – avtoturargohlarga joylashtirishga doir munosabat bilan deyarli har kuni duch keladi.
Bunday holatda avtoturargoh ma’muriyati va avtomoshina egasi o’rtasidagi munosabatni tartibga solish, jumladan avtomoshina egasi va avtoturargohning bir-biriga nisbatan bo’lgan huquq va majburiyatlariga doir normalarni o’rnatish hamda shu normalar orqali tomonlar o’rtasida yuzaga keladigan kelishuv va nizolarni tartibga solish zarurati yuzaga chiqadi. Bunday holatda tomonlar o’rtasidagi kelishuv va nizolar omonat saqlash shartnomasi orqali tartibga solinadi. Avtomoshina egasi yuk topshiruvchi maqomida, avtoturargoh esa omonat saqlovchi maqomida bo’ladi.
Mazkur ishda avtotransport vositasini avtoturargohda omonat saqlash shartnomasining mazmun mohiyati, ushbu munosabatni tartibga solishdagi xorijiy tajriba, chet el mamlakatlarining yutuq va kamchiliklari, sohani O’zbekiston Respublikasidagi kelajagi atroflicha muhokama qilinadi.
